The Noniz – Mural Terms & Conditions

Version 1.0

These Terms & Conditions apply specifically to all custom mural commissions completed by The Noniz.

By accepting a quotation or commissioning a mural, the client agrees to these terms. These conditions are intended to create clear expectations and ensure a smooth collaboration for both parties.

1. Scope of Work

Each mural is a custom artwork created specifically for the agreed location and designed in the signature artistic style of The Noniz.

The scope of work, timeline and pricing are outlined in the accepted quotation.

2. Design Process

Each project includes:

  • One custom mural concept

  • One revision round

  • Final design approval before painting begins

Additional design revisions or major changes after approval may result in additional charges.

3. Deposit & Payment

A 50% non-refundable deposit is required to secure the project date.

The remaining balance is due within 14 days after completion of the mural.

Painting will not begin until the deposit has been received.

4. Materials

Unless otherwise stated, all paint, materials and standard equipment are included in the quoted price.

Additional requests outside the agreed scope may result in additional costs.

5. Client Responsibilities

The client is responsible for ensuring:

  • safe access to the wall

  • sufficient working space

  • access to electricity (if required)

  • permission to paint the wall

  • a clean and suitable painting surface

If unexpected preparation work is required before painting can begin, additional costs may apply.

6. Wall Condition

The client acknowledges that the durability and appearance of a mural depend on the condition of the wall.

The Noniz cannot be held responsible for issues caused by:

  • moisture

  • mould

  • unstable paint

  • peeling paint

  • structural movement

  • cracks

  • damaged plaster

  • unsuitable wall preparation

  • previous coatings

  • poor adhesion of existing paint

7. Outdoor Murals

Outdoor murals are exposed to weather and environmental conditions.

The Noniz cannot guarantee the lifespan of an outdoor mural and is not liable for deterioration caused by:

  • UV exposure

  • rain

  • frost

  • humidity

  • pollution

  • vandalism

  • accidental damage

  • natural ageing

8. Scheduling

Project dates are estimated.

Painting dates may change due to illness, force majeure or unsuitable weather conditions.

The Noniz will always communicate any schedule changes as soon as possible.

9. Completion

Upon completion, the mural will be reviewed with the client.

Minor touch-ups related to the agreed design will be completed free of charge.

Any changes requested after approval of the completed mural will be quoted separately.

10. Colour Variations

Every effort is made to match approved colours as accurately as possible.

Small colour differences may occur due to paint pigments, lighting conditions, wall texture or digital screen variations and are not considered defects.

11. Cancellation

If the client cancels the project after accepting the quotation, the deposit remains non-refundable to cover design work, planning and preparation already completed.

12. Copyright & Intellectual Property

All mural concepts, sketches and finished artwork remain the intellectual property of The Noniz.

Clients may not reproduce, copy, modify or commercially exploit the artwork without written permission.

The Noniz retains the right to create prints, merchandise or other reproductions of the original artwork unless agreed otherwise in writing.

13. Photography & Portfolio

Unless agreed otherwise, The Noniz reserves the right to photograph and film completed murals for use in:

  • Portfolio

  • Website

  • Social media

  • Exhibitions

  • Promotional material

14. Limitation of Liability

The Noniz shall only be liable for direct damage resulting from proven negligence during the execution of the agreed work.

The Noniz is not liable for indirect damage, consequential loss, loss of profit, damage caused by third parties, or defects resulting from unsuitable wall conditions or circumstances beyond reasonable control.

15. Governing Law

These Terms & Conditions are governed by the laws of the Netherlands.

Any disputes shall be submitted to the competent court in the Netherlands.

16. Creative Freedom

While client preferences, themes and colours are carefully considered, each mural is an original artwork created in the signature style of The Noniz.

The final composition, artistic interpretation and painting technique remain at the discretion of the artist, unless otherwise agreed in writing.
