These terms and conditions apply to all agreements you enter into with The Noniz B.V.

DEFINITIONS

The Noniz
The Noniz is a brand and platform operated by NaturallyNona B.V., a private limited liability company registered with the Chamber of Commerce under number 85781568. All agreements concluded via The Noniz platform are legally entered into with NaturallyNona B.V.

The Shop
The webshop via the Platform www.thenoniz.com where products (such as art products, subscriptions, courses and creative content) can be purchased.

Member
The natural person who subscribes to a paid membership or course with The Noniz and gains access to the online learning environment, community, or other services.

Content
All texts, images, videos, audio, blogs, drawings, and other materials on www.thenoniz.com and its associated platform.

Services
All online and offline services offered by The Noniz, such as creative coaching, workshops, memberships, and courses.

Platform
The digital platform www.thenoniz.com including associated social media channels and learning environments.

Membership
The subscription that grants access to exclusive content, courses, and community on www.thenoniz.com.

Article 1 – Applicability

1.1 By using the Platform you agree to these terms and conditions.
1.2 Any other terms are expressly excluded.
1.3 The Noniz reserves the right to amend these terms. If you object to the changes, notify us within 14 days via thenoniz.family@gmail.com. After that period, you are deemed to have accepted the changes.
1.4 Products and services are only available to persons aged 18 or older, unless otherwise stated.

Article 2 – Agreement

2.1 The agreement is concluded when you place an order via www.thenoniz.com and receive an order confirmation.
2.2 Prices are valid as long as indicated or while stocks last.
2.3 The price in the order confirmation applies, excluding shipping costs.
2.4 Obvious errors in price or description may be corrected.
2.5 Price changes due to external factors may be passed on.
2.6 For memberships and courses, a profile must be created. Profile removal requests can be sent to thenoniz.family@gmail.com.

Article 3 – Payment

3.1 Payment must be made in advance via the offered payment methods. Membership fees are automatically collected per period.
3.2 If a payment is reversed or fails, your payment obligation remains, plus possible additional costs.
3.3 Late payment leads to reminders and possible debt collection.
3.4 Collection costs are at your expense.
3.5 Payments will first be applied to costs and interest, then to the principal.
3.6 Payments may not be withheld or offset.
3.7 Services may be suspended or agreements dissolved in case of payment default.

Article 4 – Delivery and risk

4.1 Delivery times are indicative and do not entitle you to compensation.
4.2 Risk transfers to you once products are delivered at the address provided.

Article 5 – Cancellation and withdrawal rights

5.1 Print-on-demand products, such as customized shirts, are excluded from the right of withdrawal. This means you cannot cancel or return these products after delivery, unless they are defective or damaged upon receipt.
5.2 For other products, you have 14 days from receipt to cancel and return the product, provided it is unused, undamaged, and in the original packaging. Return shipping costs are your responsibility.
5.3 For services, you can cancel within 14 days after the order confirmation, unless the service has already started (e.g., a membership, coaching, or course), in which case the withdrawal right expires.
5.4 Refunds will be processed within 14 days after receipt of the returned product or confirmation of cancellation, minus the amount for any used services.

Article 6 – Complaints and warranty

6.1 Complaints must be reported within 14 days to thenoniz.family@gmail.com.
6.2 If justified, The Noniz will repair, replace, or refund.
6.3 Products are offered without guarantees on results.
6.4 Warranty only applies if products are used correctly.
6.5 Services are efforts to perform without guaranteed results.

Article 7 – Liability

7.1 The Noniz does not provide advice on life decisions and does not replace professional help.
7.2 No liability for indirect damage or misuse.
7.3 No liability for third-party services offered through the Platform.
7.4 The Noniz is not responsible for external links.

Article 8 – Intellectual property and privacy

8.1 The Noniz owns all intellectual property rights to content. Copying or distributing without permission is prohibited.
8.2 Infringement may lead to penalties of €500 per day, up to €10,000.
8.3 Personal data is processed in accordance with the GDPR; see the privacy policy at www.thenoniz.com.

Article 9 – Membership

9.1 Memberships grant personal access to services.
9.2 Price changes are communicated in advance.
9.3 Membership can be canceled via the platform with one month’s notice from the following month.
9.4 After cancellation, the profile remains inactive.
9.5 Fraud leads to profile suspension or deletion.

Article 10 – Miscellaneous

10.1 Dutch law applies.
10.2 Invalid provisions will be replaced by provisions with a similar intent.
10.3 Disputes will be settled by the competent court in Leiden, the Netherlands.
